KESETARAAN GENDER DAN REFORMASI HUKUM: PEMIKIRAN AMINA WADUD DAN SITI MUSDAH MULIA DALAM KONTEKS INDONESIA

Abstract


Abstract. This study discusses the thoughts of Amina Wadud and Siti Musdah Mulia on gender equality and legal reform in the context of Islam, particularly in Indonesia. This topic is significant because gender equality in Islamic law remains a challenge in Indonesia. The aim of this research is to analyze how the progressive ideas of these two figures can be applied in public policy to promote gender equality in Indonesia. This research uses a literature study method that includes description, interpretation, critical analysis, and a comparative approach to the thoughts of Wadud and Musdah Mulia. The findings reveal that Wadud’s ideas provide a theological foundation for more equitable legal reform, while Musdah Mulia’s ideas offer practical guidance for family law reform in Indonesia. The novelty of this research lies in combining theological and practical approaches to promote more inclusive and gender-just policies in Indonesia.

 

Abstrak. Penelitian ini membahas pemikiran Amina Wadud dan Siti Musdah Mulia terkait kesetaraan gender dan reformasi hukum dalam konteks Islam, khususnya di Indonesia. Topik ini penting karena kesetaraan gender dalam hukum Islam masih menjadi tantangan di Indonesia. Tujuan penelitian ini adalah menganalisis bagaimana pemikiran progresif kedua tokoh tersebut dapat diterapkan dalam kebijakan publik di Indonesia untuk mendukung kesetaraan gender. Penelitian ini menggunakan metode studi literatur yang mencakup deskripsi, interpretasi, analisis kritis, dan pendekatan komparatif terhadap pemikiran Wadud dan Musdah Mulia. Hasil penelitian menunjukkan bahwa pemikiran Wadud dapat memberikan landasan teologis untuk reformasi hukum yang lebih adil, sementara pemikiran Musdah Mulia memberikan arah praktis untuk reformasi hukum keluarga Islam di Indonesia. Kebaruan penelitian ini terletak pada penggabungan pendekatan teologis dan praktis untuk mendorong kebijakan yang lebih inklusif dan berkeadilan gender di Indonesia.
