Israel-Palestine War: The Right of Self-Defense in International Law
Abstract
This paper examines the use of force in self-defence under customary international in the Israel-Palestine war and examines the 7 October 2023 attacks by the Harakat al-Muqawam al-Islamiya) Hamas) and Palestinian Islamic Jihad (PI) can be construed within the parameter of Article 51 of the United Nations Charter as an “armed attack” against Israel to justify the use of military force in self-defense against non-state actors. The right to use force in self-defense in international and criminal law to justify it to counter an armed attack or imminent threat. This is recognised as jus ad bellum, signifying "when it is just to initiate conflict," all forms of self-defence must adhere to the tenets of the Caroline principles.
