ABOLISI SISTEM WAKAF DI TUNISIA: SIKAP UNIVERSITAS AZ-ZAITUNA DALAM TINJAUAN NORMATIF FIKIH

Abstract

Abstract

This research aims to understand the reality of waqf and the stance of Zaituna University regarding its cancellation in the Republic of Tunisia. The researcher uses a descriptive-analytical approach by describing Zaituna University's stance on the abolition of waqf in the Republic of Tunisia. The researcher analyzes their views on the cancellation of waqf within the context occurring in the Republic of Tunisia. The research was conducted through literature and field studies, including interviews with the rector of Zaituna University, several faculty deans, and teaching staff involved or interested in the issue of waqf in Tunisia. Additionally, the researcher accessed books, articles, and websites related to the abolition of waqf in Tunisia to gain an understanding of Zaituna University's stance on the issue. The researcher found that Zaituna University's stance on the cancellation of waqf in the Republic of Tunisia is oppositional, as it is considered contrary to Islamic jurisprudence from the perspective of waqif's annulment law, siyasah syar’iyah, maqashid syar’iyah, and sadd adzari’ah. Zaituna University not only opposes but also refutes all arguments used to justify the abolition of waqf, ranging from economic disruption and threats to the nation's civilization to support for terrorism. Thus, Zaituna University continues to strive for the reimplementation of waqf laws through efforts to educate the public about the importance of waqf and by consulting with the Ministry of Religious Affairs regarding waqf law proposals and submitting them for ratification.

Abstrak

Penelitian ini bertujuan memahami realitas waqf dan sikap Universitas Zaituna terhadap pembatalannya di Tunisia. Pendekatan deskriptif-analitis digunakan untuk menggambarkan sikap Universitas Zaituna terkait abolisi waqf di Tunisia serta menganalisis pandangan mereka dalam konteks yang terjadi di negara tersebut. Penelitian dilakukan melalui studi pustaka dan lapangan, termasuk wawancara dengan rektor Universitas Zaituna, beberapa dekan fakultas, serta dosen yang terlibat atau tertarik dengan isu waqf di Tunisia. Selain itu, peneliti mengakses buku, artikel, dan situs web terkait untuk memahami sikap universitas terhadap abolisi waqf. Hasil penelitian menunjukkan bahwa Universitas Zaituna menentang abolisi waqf karena bertentangan dengan fiqh Islam dari aspek hukum pembatalan waqif, siyasah syar’iyah, maqashid syar’iyah, dan sadd adzari’ah. Universitas ini tidak hanya menolak tetapi juga membantah semua alasan yang mendukung abolisi waqf, termasuk gangguan ekonomi dan ancaman terhadap peradaban. Oleh karena itu, Universitas Zaituna terus berupaya mengembalikan hukum waqf melalui edukasi publik serta konsultasi dengan Kementerian Agama mengenai proposal hukum waqf untuk disahkan.
