Licensing Problems for the Corruption Eradication Commission Against Efforts to Tap Corruption Suspects

Abstract

The process of rewriting the KPK law resulted in the establishment of a new structure inside the anti-corruption commission. With the establishment of the KPK Supervisory Board, the KPK's performance must be adjusted in accordance with the outcome of the law change. The purpose of this article is to describe instances of license challenges encountered by KPK personnel or detectives while attempting to wiretap corruption suspects before the KPK Supervisory Board. This emerged as a result of the change of the most recent KPK law, specifically Law No. 19 of 2019, which created numerous bureaucracy that impede investigators' ability to carry out measures to eradicate corruption. The performance of investigators who are forced to work quickly and without regard for layers of bureaucracy associated with wiretapping. The study method employed is a normative juridical approach grounded in the statutory framework. According to the findings of the research, the most recent amendment of the KPK law requires that wiretapping mechanisms for corruption suspects get permits and pass through layers of bureaucracy. The Constitutional Court granted a significant claim related to the article controlling wiretapping following a judicial review. Now, the KPK notifies the Supervisory Board no later than 14 (fourteen) business days following the wiretapping. This is advantageous because the investigator's actions are impenetrable and can proceed quickly.
