Domains of Judgment upon the Expert’s Opinion in Contemporary Financial Transactions Murabaha to Purchase Orderer, and Contracting Companies as Examples

Abstract

Abstrak: Penelitian ini membahas masalah kontemporer yang penting berjudul  “  seputar penerapan hukum berdasarkan pendapat ahli dalam transaksi keuangan kontemporer “. Di sini para peneliti memulai dengan menjelaskan definisi “Ahli”, mengungkap jenis jenis nya, lalu menjelaskan persyaratannya untuk kemudian disimpulkan sejauh mana kekuatan opini dan pendapat para ahli itu bisa digunakan. Kemudian para peneliti membahas beberapa bidang  yang menjadi acuan perkataan para ahli dalam penerapan dua transaksi keuangan kontemporer  bernama ; Murabahah Pesanan pembeli  dan perusahaan kontruksi.

Kami telah sampai kepada beberapa kesimpulan dimana hal hal terpenting nya adalah sebagai berikut; bahwa kompensasi kerusakan barang dalam akad Murabahah pesanan pembeli dirujuk ke perkataan para ahli  dalam dua kasus: Kasus pertama, ketika kompensasi kerusakan finansial yang disebabkan oleh lembaga keuangan, seperti : pengembalian barang dagangan yang rusak. Kasus Kedua, ketika kompensasi kerusakan finansial disebabkan oleh pemesan barang, seperti : mundurnya si pemesan dari pembelian  barang pesanannya.

Adapun dalam hal perusahaan kontruksi, maka boleh merujuk kepada perkataan para ahli dalam dua kasus juga; Kasus pertama: menjalankan perkataan Ahli dalam kompensasi kerusakan finansial yang disababkan oleh perusahaan kontruksi, seperti : kompensasi atas tidak terpenuhi nya kontrak. Kasus ke dua : kompensasi  kerusakan finansial yang disebabkan oleh mitra / klien, seperti : kompensasi akibat tidak profesional nya kontraktor yang bersangkutan dalam menjalankan kontrak nya.

    Abstract: This research discusses an important contemporary issue, namely, the domains of making judgments upon expert’s opinion in contemporary financial transactions. Both researchers start by presenting the concept of the expert, revealing its types, clarifying its terms, and determining the extent of its power. The researchers then discuss the domains of referring to expert’s opinions relevant to two questions of contemporary financial transactions, namely: Murabaha to purchase orderer and contracting companies. This paper draws a number of findings, the most important of which are: Expert's opinion can be referred to in indemnity for damages in Murabaha to the purchase orderer in two cases: indemnity for financial damages caused by the financial institution, such as: returning defective merchandise. The second case is: indemnity for financial damages caused by the purchase orderer, such as: the buyer's abstention from buying the items ordered for purchase.

In contracting companies, expert’s opinion is referred to in two cases as well: first: indemnity for financial damages caused by contracting companies, such as: compensation for not completing the contract. The second case is: compensation for financial damages caused by the client, such as: compensation for not enabling the contractor to complete the contract.
